  Requiring trans men to wear tight-fitting swimwear is discriminatory. This is stated in a ruling by the Disputes Chamber of the Flemish Institute for Human Rights, following a complaint filed by a trans man.

  The trans man wanted to go swimming at the Sportoase Montaignehof pool in Lanaken, but was not allowed to wear loose-fitting swimwear. Only tight-fitting swimwear is permitted there for hygiene reasons. However, he wanted to wear loose swimwear because otherwise it would be visible that he has not undergone gender-affirming surgery.

  The Disputes Chamber of the Flemish Institute for Human Rights follows this reasoning and rules that there is indirect discrimination based on gender identity and expression. The ban means that the complainant and other trans men in the same situation cannot use the pool without others being aware of their gender identity.

  The Chamber acknowledges that the pool pursues a legitimate aim with this ban, such as ensuring safety and hygiene, but finds that the operator has not demonstrated that there are no other effective measures, such as requiring swimmers to shower beforehand. Another argument raised by the pool was that loose swimwear retains more water, preventing it from being reused. However, according to the Chamber, there are swimwear fabrics that absorb very little water.

  The Disputes Chamber recommends that the pool take measures to allow the complainant to use the pool without others identifying him as a trans man, and to amend its regulations to allow loose-fitting swimwear.

  Obliger les hommes trans à porter un maillot de bain moulant est discriminatoire. C’est ce qui ressort de la décision de la Chambre des litiges de l’Institut flamand des droits humains, à la suite d’une plainte introduite par un homme trans.

  L’homme trans souhaitait aller nager à la piscine de Sportoase Montaignehof à Lanaken, mais il n’était pas autorisé à porter un maillot de bain ample. Seuls les maillots de bain ajustés y sont autorisés pour des raisons d’hygiène. L’homme trans souhaitait toutefois porter un maillot ample, car sinon il serait visible qu’il n’a pas subi d’opération de réassignation de genre.

  La Chambre des litiges de l’Institut flamand des droits humains suit ce raisonnement et estime qu’il s’agit d’une discrimination indirecte fondée sur l’identité et l’expression de genre. L’interdiction a pour conséquence que le plaignant et d’autres hommes trans dans la même situation ne peuvent pas utiliser la piscine sans que leur identité de genre soit révélée.

  La Chambre reconnaît que la piscine poursuit un objectif légitime avec cette interdiction, notamment en matière de sécurité et d’hygiène, mais elle estime que l’exploitant ne démontre pas qu’il n’existe pas d’autres mesures efficaces, comme l’obligation de se doucher avant de nager. Un autre argument avancé par la piscine était que les maillots amples retiennent plus d’eau, empêchant sa réutilisation. Toutefois, selon la Chambre, il existe des textiles de bain qui absorbent peu l’eau.

  La Chambre des litiges recommande à la piscine de prendre des mesures afin de permettre au plaignant d’utiliser la piscine sans que les autres puissent l’identifier comme homme trans, et d’adapter son règlement pour autoriser les maillots de bain amples.

• Transmannen verplichten om speedo's te dragen is discriminerend

  Transmannen verplichten om een strakzittende zwembroek te dragen is discriminerend voor transmannen. Dat staat te lezen in het oordeel van de Geschillenkamer van het Vlaams Mensenrechteninstituut na een klacht van een transman.

  De transman wilde gaan zwemmen in het zwembad van Sportoase Montaignehof in Lanaken, maar mocht daar geen loszittende zwembroek dragen. Enkel aansluitende zwembroeken zijn daar om hygiënische redenen toegelaten. De transman wilde echter een loszittende zwembroek dragen omdat anders zichtbaar is dat hij geen genderbevestigende operatie heeft ondergaan.

  De Geschillenkamer van het Vlaams Mensenrechteninstituut volgt die redenering en oordeelt dat er sprake is van indirecte discriminatie op grond van genderidentiteit en genderexpressie. Het verbod leidt ertoe dat de indiener van de klacht en andere transmannen in dezelfde situatie het zwembad niet kunnen gebruiken zonder dat anderen hun genderidentiteit kennen, klinkt het.

  De Geschillenkamer beveelt het zwembad om maatregelen te nemen zodat het voor de indiener van de klacht mogelijk wordt om het zwembad te gebruiken zonder dat anderen hem kunnen identificeren als transman, en het reglement aan te passen om zwemmen in loszittend zwemtextiel toe te laten.

• VS vangt bot bij VN met voorstel over definitie van gender

  De Verenigde Naties hebben met een grote meerderheid een Amerikaans resolutievoorstel verworpen dat het begrip ‘gender’ zou beperken tot mannen en vrouwen. Samen met België stemden 23 landen tegen het resolutievoorstel. Zeventien landen onthielden zich van de stemming en slechts twee landen, Pakistan en Chili, stemden samen met de Verenigde Staten voor het voorstel.

  De Amerikaanse resolutie werd op 19 maart, de laatste dag van de zeventigste jaarlijkse Commissie voor de Status van de Vrouw, ingediend. Uit een kladversie die de Amerikaanse website PassBlue kon inkijken, blijkt dat de Amerikanen van mening zijn dat er te veel connotaties hangen rond het begrip ‘gender’ en dat die de laatste jaren steeds vaker worden gebruikt en afwijken van eerder geaccepteerde definities.

  In de resolutie werd ook verwezen naar de Verklaring van Peking over vrouwenrechten uit 1995, die gender op die manier zou definiëren. Maar uit een brief van de Women’s Rights Caucus, die vorige week naar de afgevaardigden werd gestuurd, blijkt dat de commissie geen specifieke definitie van gender hanteerde.

  Volgens PassBlue zei Cristal Downing, directeur gender bij de International Crisis Group, dat de lidstaten “het eens waren om het oneens te zijn” over de definitie en dat ze “zich comfortabeler voelden bij het open laten van de term voor interpretatie dan bij elke poging om tot een gezamenlijke definitie te komen”.

  Volgens de Belgische vertegenwoordiger is de ingediende Amerikaanse resolutie echter “feitelijk onjuist” en probeert ze “de Verklaring van Peking te herschrijven”. Ons land riep dan ook op tot een “no action motion” om te voorkomen dat de resolutie verder zou worden behandeld.

• Already 8,000 registrations for the Gay Games in Valencia

  With only a few months to go, 8,000 athletes have already registered for the twelfth edition of the Gay Games in Valencia. The international sporting and cultural event, which takes place every four years and is based on participation, inclusion and personal achievement, will be held from 27 June to 4 July 2026.

  The 2026 edition will feature more than 30 sports disciplines, including water sports, athletics, badminton, basketball and fencing, as well as local sports such as colpbol and pilota valenciana.

  According to the organisers, participants can still register for many sports disciplines, except for swimming, weightlifting and tennis, where maximum capacity has already been reached.

  Only a handful of places remain in badminton, wrestling, the five and ten kilometre races, open water swimming, figure skating, softball and several other sports. In these disciplines, participation rates currently range between 70 and 80 percent.

• Déjà 8 000 inscriptions pour les Gay Games à Valence

  À quelques mois de l’événement, 8.000 sportifs se sont déjà inscrits pour la douzième édition des Gay Games à Valence. Cet événement international sportif et culturel, organisé tous les quatre ans et basé sur la participation, l’inclusion et la performance personnelle, se déroulera cette année du 27 juin au 4 juillet 2026.

  L’édition 2026 comprendra plus de 30 disciplines sportives, dont des sports aquatiques, l’athlétisme, le badminton, le basket-ball et l’escrime, ainsi que des sports locaux comme le colpbol et la pilota valenciana.

  Selon les organisateurs, les participants peuvent encore s’inscrire à de nombreuses disciplines sportives, à l’exception de la natation, de l’haltérophilie et du tennis, où la capacité maximale est déjà atteinte.

  Il reste encore quelques places pour le badminton, la lutte, les courses de cinq et dix kilomètres, la natation en eau libre, le patinage artistique, le softball et plusieurs autres disciplines. Dans ces sports, le taux d’occupation varie entre 70 et 80 %.

• Reeds 8.000 inschrijvingen voor Gay Games in Valencia

  Met nog een paar maanden te gaan hebben al 8.000 sportievelingen zich ingeschreven voor de twaalfde editie van de Gay Games in Valencia. Het internationale sportieve en culturele evenement, dat om de vier jaar wordt georganiseerd en gebaseerd is op participatie, inclusie en persoonlijke topprestaties, vindt dit jaar plaats van 27 juni tot 4 juli 2026.

  De editie van 2026 zal meer dan 30 sportdisciplines omvatten, waaronder watersporten, atletiek, badminton, basketbal en schermen, evenals lokale sporten zoals colpbol en pilota valenciana.

  Er zijn nog een handvol inschrijvingen mogelijk voor badminton, worstelen, de vijf en tien kilometerloop, openwaterzwemmen, figuurschaatsen, softbal en verschillende andere sporten. Daar varieert de bezettingsgraad tussen de 70 en 80 procent.

• Musicalhit Dear Evan Hansen voor het eerst in Vlaanderen

  Van 4 september tot en met 4 oktober brengt Inteam Productions de musical ‘Dear Evan Hansen’ in de Rode Zaal van het Fakkeltheater in Antwerpen. Met deze musical heeft het Antwerpse gezelschap, dat eerder al 'Lelies', ‘Kinky Boots’ en 'Spring Awakening’  bracht, opnieuw een Belgische premiere te pakken. 

  “Het is steeds een uitdaging om aantrekkelijke titels te verwerven voor de kleine musicalmarkt die Vlaanderen is”, zo laat producent Niels de Valk weten. “Dat het ons met ‘Dear Evan Hansen’ opnieuw is gelukt, sterkt ons in het feit dat ook buitenlandse auteursrechtenbureaus de kwaliteit van onze producties erkennen.”

  Dear Evan Hansen vertelt het ontroerende verhaal van Evan, een sociaal onzekere tiener die plots terechtkomt in een leugen die groter wordt dan hijzelf. Wat begint als een poging om ergens bij te horen, groeit uit tot een verhaal over eenzaamheid, verbondenheid en zoektocht naar jezelf, in een harde wereld gedomineerd door sociale media.  Dear Evan Hansen wordt geprezen om de rauwe en eerlijke manier waarop complexe, actuele thema's worden behandeld, in het bijzonder mentale gezondheid, eenzaamheid en de impact van sociale media. 

  Deze moderne musicalhit van Benj Pasek en Justin Paul won meerdere Tony Awards (oa Best Musical, Best Book en Best Score) en groeide uit tot één van de meest geliefde musicals van het afgelopen decennium. 

   

  “We maken in dit geval opnieuw een zogenaamde ‘non-replica’ versie, die dus met name qua vormgeving afwijkt van de originele productie op Broadway en West End”, aldus Niels de Valk. “Maar dat geeft ons weer de gelegenheid om ons eigen ‘ding’ ermee te kunnen doen, wat het publiek ook van ons gewend is. We mochten bovendien al vaststellen dat ons publiek met veel enthousiasme zat te wachten op de aankondiging van deze bijzondere titel, gezien de warme reacties die we mochten ontvangen op de eerste teaser op onze social media. De thematiek van deze musical past perfect bij het profiel van InTeam als productiehuis, waar we gevoelige sociale thema’s niet schuwen. En de productie geeft ruimte om een nieuwe generatie musicalartiesten in het voetlicht te plaatsen.’

  De audities zijn momenteel in volle gang: InTeam gaat zoals steeds op zoek naar jong, aanstormend musicaltalent, aangevuld met meer ervaren musicalartiesten. 

  De creatieve leiding is in handen van Niels de Valk, die samen met Brecht Callewaert de regie voert. Charles Vanden Broucke is muzikaal leider. Matthew Michel staat in voor de choreo en staging. De rest van het creatieve team wordt op een later moment bekend gemaakt, net zoals de cast.

• NGOs call on the IOC to stop genetic sex testing in sport

  In a joint statement, Sport & Rights Alliance (SRA), ILGA World and Humans of Sport are calling on the International Olympic Committee (IOC) to stop sex testing for female athletes. The three organisations are also supported by seventy other organisations.

  According to several sources, the “Working Group on the protection of the female category” has recommended that the IOC introduce universal genetic sex testing for all female athletes and impose a complete ban on transgender and intersex athletes. According to the three organisations, this would roll back progress on gender equality and women’s sport by thirty years.

  “A policy of sex testing and a blanket ban would be a catastrophic erosion of women’s rights and safety,” said Andrea Florence, Executive Director of the Sport & Rights Alliance. “Gender policing and exclusion harm all women and girls and undermine the very dignity and fairness the IOC claims to uphold. Our concerns are compounded by the fact that the IOC also appears to be scaling back the safe sport infrastructure that is meant to protect women and girls.”

  After the 1996 Olympic Games, the IOC voted to discontinue universal sex testing because it was scientifically and ethically unjustifiable. The tests proved to be an inaccurate way of determining both sex and athletic advantage and caused significant harm to affected athletes. The United Nations High Commissioner for Human Rights, UN Women, the World Medical Association, the American Medical Association and most recently a group of independent UN experts have long condemned sex testing and medically unnecessary interventions as discriminatory, unethical and harmful.

  “Requiring women and girls to undergo genetic screening just to participate in sport would revive a practice that, even if it is a one-time test, violates women’s and girls’ privacy, exposes them to extreme public scrutiny and humiliation, and opens the door to medically unnecessary interventions,” said Dr Payoshni Mitra, Executive Director of Humans of Sport. “People often forget that child athletes compete at the Olympic Games and international competitions. This policy would create major safeguarding risks by requiring young women’s and children’s bodies to be investigated and their intimate medical information disclosed.”

  “Banning transgender and intersex athletes in the name of ‘fairness’ ignores the fact that these athletes are among the most stigmatised groups in sport,” the organisations said. “They disproportionately face barriers to participation, widespread harassment and abuse, and other disadvantages. There is no evidence that policing women’s and children’s bodies improves fairness or gender equality in sport.”

  “Sport should be a place of belonging,” said Julia Ehrt, Executive Director of ILGA World. “We urge the IOC to prioritise safety over politics and not allow a policy that actively puts all women at risk. Invasive policing of women’s bodies should concern everyone because it reinforces harmful stereotypes and exposes all women and LGBTI athletes to further harassment and scrutiny.”

  If implemented, the new policy would represent a complete reversal of the IOC’s own 2021 Framework on Fairness, Inclusion and Non-Discrimination. This widely respected document was developed following extensive research and consultation with more than 250 athletes and experts and recognised the need for evidence-based, sport-specific and human rights-respecting eligibility rules.

  The Sport & Rights Alliance, ILGA World, Humans of Sport and the undersigned organisations call on the IOC to immediately reverse these plans for sex testing and bans based on chromosome status, and to fulfil its commitments under the Olympic Charter, which states that every individual must have “access to the practice of sport, without discrimination of any kind in respect of internationally recognised human rights.”

• Des ONG appellent le CIO à mettre fin aux tests génétiques de sexe dans le sport

  Dans un communiqué commun, Sport & Rights Alliance (SRA), ILGA World et Humans of Sport appellent le Comité international olympique (CIO) à mettre fin aux tests de sexe pour les athlètes féminines. Les trois organisations bénéficient également du soutien de soixante-dix autres organisations.

  Selon plusieurs sources, le "Groupe de travail sur la protection de la catégorie féminine" aurait recommandé au CIO d’introduire des tests génétiques universels pour toutes les athlètes féminines et d’imposer une interdiction totale de participation aux athlètes transgenres et intersexes. Selon les trois organisations, cela ferait reculer de trente ans les progrès en matière d’égalité de genre et dans le sport féminin.

  "Une politique de tests de sexe et d’interdiction générale constituerait une atteinte catastrophique aux droits et à la sécurité des femmes", déclare Andrea Florence, directrice exécutive de la Sport & Rights Alliance. "La police du genre et l’exclusion nuisent à toutes les femmes et à toutes les filles et sapent précisément la dignité et l’équité que le CIO prétend défendre. Nos inquiétudes sont d’autant plus grandes que le CIO semble également réduire les infrastructures de “safe sport”, qui visent justement à protéger les femmes et les filles."

  Après les Jeux olympiques de 1996, le CIO avait décidé de mettre fin aux tests universels de sexe, estimant qu’ils n’étaient ni scientifiquement ni éthiquement justifiables. Ces tests se sont révélés être une méthode imprécise pour déterminer à la fois le sexe et l’avantage sportif et ont causé des préjudices importants aux athlètes concernés. Le Haut-Commissariat des Nations unies aux droits de l’homme, ONU Femmes, la World Medical Association, l’American Medical Association et plus récemment un groupe d’experts indépendants des Nations unies ont depuis longtemps condamné les tests de sexe et les interventions médicales non nécessaires comme étant discriminatoires, contraires à l’éthique et préjudiciables.

  "Obliger les femmes et les filles à subir un dépistage génétique simplement pour pouvoir participer au sport ferait revivre une pratique qui ,même s’il s’agit d’un test unique,viole la vie privée des femmes et des filles, les expose à un examen public extrême et à l’humiliation, et ouvre la voie à des interventions médicales inutiles ", explique la docteure Payoshni Mitra, directrice exécutive de Humans of Sport. "On oublie souvent que des athlètes mineurs participent également aux Jeux olympiques et aux compétitions internationales. Cette politique créerait des risques majeurs pour leur protection, car elle exigerait l’examen du corps de jeunes femmes et d’enfants et la divulgation d’informations médicales intimes."

  "Interdire les athlètes transgenres et intersexes au nom de l’“équité” ignore le fait que ces athlètes font partie des groupes les plus stigmatisés dans le sport", déclarent les organisations. "Elles sont confrontées de manière disproportionnée à des obstacles à la participation sportive, à du harcèlement et à des abus répandus ainsi qu’à d’autres formes de désavantage. Il n’existe aucune preuve que le contrôle des corps des femmes et des enfants améliore l’équité ou l’égalité de genre dans le sport."

  "Le sport doit être un lieu d’appartenance", déclare Julia Ehrt, directrice exécutive d’ILGA World. "Nous appelons le CIO à privilégier la sécurité plutôt que la politique et à ne pas autoriser une politique qui mettrait activement toutes les femmes en danger. La surveillance intrusive des corps des femmes devrait inquiéter tout le monde, car elle renforce des stéréotypes nuisibles et expose toutes les femmes et les athlètes LGBTI à davantage de harcèlement et de contrôle."

  Si cette nouvelle politique était adoptée, elle constituerait un revirement complet par rapport au cadre du CIO de 2021 sur l’équité, l’inclusion et la non-discrimination. Ce document largement respecté a été élaboré à la suite de recherches approfondies et de consultations avec plus de 250 athlètes et experts et reconnaît la nécessité de règles d’éligibilité fondées sur des preuves, spécifiques à chaque sport et respectueuses des droits humains.

  La Sport & Rights Alliance, ILGA World, Humans of Sport et les organisations signataires appellent le CIO à abandonner immédiatement ces projets de tests de sexe et d’interdiction des femmes sur la base de leur statut chromosomique, et à respecter ses engagements inscrits dans la Charte olympique, qui stipule que chaque individu doit avoir "accès à la pratique du sport, sans discrimination d’aucune sorte au regard des droits humains internationalement reconnus".
